West Bengal Licences

Explore business permissions and registrations DCA handles within West Bengal only.

L01Which registrations might a small business in West Bengal need?

The checklist depends on the business, premises, employees and selling activity. It may involve local trade permission, Shops and Establishments requirements, tax registrations and activity-specific licences. Do not buy a package containing every registration before checking applicability.

West Bengal
L02Is a trade licence the same as GST registration?

No. A trade licence or Certificate of Enlistment concerns the applicable local-authority process. GST registration concerns indirect-tax obligations. Having one does not automatically satisfy the other requirement.

West Bengal
L03Does KMC issue trade licences for every business in West Bengal?

No. The relevant authority depends on the premises’ location. A business in another municipality or a panchayat area may follow a different route. Confirm the jurisdiction rather than selecting KMC merely because the consultant is based in Kolkata.

L04What documents are usually needed for a West Bengal trade licence?

The relevant checklist generally includes accepted identity and occupancy evidence, with different options for an owner, tenant, lessee or consent-based user. Entity and premises circumstances can require additional records. Do not assume every applicant needs every listed ownership document.

West Bengal
L05Are trade licence and Shops and Establishments registration separate?

They address different requirements, although a combined application process is available in applicable West Bengal municipal areas. Check what the application actually provides. A certificate covering one requirement should not be assumed to cover every employment or operational obligation.

West Bengal
L06Can I operate a business from my home in West Bengal?

Possibly, depending on the activity and premises restrictions. Registration eligibility, permitted use, housing-society or lease conditions and activity-specific requirements must all be considered. An online registration does not automatically authorise every type of commercial operation from a residence.

West Bengal
L07Does a home bakery or cloud kitchen need FSSAI registration or a licence?

Food businesses need to assess the applicable FSSAI route even when operated from home or without customer seating. The category depends on the current rules and business activity. Local premises and other operating requirements should be reviewed separately.

West Bengal
L08Should I still use the old ₹12 lakh FSSAI registration threshold?

No. The March 2026 reforms revised the turnover framework from 1 April 2026, including registration up to ₹1.5 crore and revised State/Central bands. Select the actual FoSCoS category using current eligibility and activity rules rather than an outdated checklist.

West BengalPeriod: Effective for new applications from 1 April 2026
L09Do FSSAI registrations and licences still require routine renewal?

The 2026 framework introduced perpetual validity, subject to the applicable implementation and transition arrangements. Ongoing fees, modifications, hygiene, safety and reporting obligations can still apply. Review the certificate and current requirements rather than treating perpetual validity as freedom from compliance.

L10Does every restaurant need to file the same FSSAI annual return?

No. Annual-return obligations depend on the licensed activity/category and applicable rules. Identify whether the business falls within the relevant return requirement before collecting production or import/export data. A generic “all food businesses must file D-1” statement is inappropriate.

West Bengal
L11Is Udyam registration free, and does it replace other licences?

Official Udyam registration is free and based on the prescribed self-declaration process. Independent advisory help can have a separate professional charge. Udyam does not replace GST, local trade permission, FSSAI or other applicable operating requirements.

West Bengal
L12When does my business need a TAN?

A TAN is relevant where the applicable tax-deduction or collection obligations require it. Check whether one already exists or was allotted through incorporation. Current TAN applications use the relevant 2026 form and supporting-document requirements; older Form 49B instructions should not be applied automatically.

West Bengal
L13Is IEC required for every business receiving money from abroad?

No. The requirement depends on the import/export activity and applicable rules. Goods trade and service receipts should not be treated identically. Review the proposed transaction before assuming a foreign payment always requires an IEC.

West Bengal
L14Does an IEC need an annual update even if nothing changes?

IEC holders must follow the applicable annual confirmation/update requirement, including where details remain unchanged. This is different from applying for a fresh IEC each year. Keep the profile, PAN, address and bank information consistent.

West Bengal
L15What is the difference between professional-tax enrolment and registration?

Enrolment concerns the applicable liability of the person/entity. Employer registration concerns obligations associated with deducting professional tax from employees. A business may need one or both, depending on the facts and West Bengal rules.

West Bengal
L16Can I open a medicine shop with only a trade licence?

No. A medicine business must assess the applicable drug-licensing requirements in addition to local permissions. Retail, wholesale and manufacturing routes differ, including premises, storage and pharmacist or competent-person requirements. Check these before committing to the premises.

West Bengal
L17Does every shop need the same fire NOC?

No. The applicable fire-related approval depends on the premises, use, size, building characteristics and governing rules. A fire licence, recommendation or safety certificate may involve different procedures. Identify the exact requirement before requesting a generic “fire NOC package”.

West Bengal
L18When should a contractor check labour-licensing requirements?

Before mobilising workers or accepting an engagement that could create coverage. Review the contractor/principal-employer relationship, worksite, workforce and current labour framework. A threshold copied from an old article may not reflect the applicable law or implementation. **11. Fresh FAQ content: West Bengal legal and property matters**
