Income Tax

Choose return forms and manage income, tax credits, notices and the 2026 tax framework transition.

T01Do I need to file an ITR if I have no tax to pay?

Possibly. Filing requirements and final tax payable are different questions. Income, specified transactions, status and other conditions can trigger filing even when deductions, rebate or tax credits leave no balance payable.

T02My employer has deducted TDS. Why might I still need to file an ITR?

TDS is tax collected during the year, not a substitute for checking your return-filing obligation. Your return combines the relevant income, deductions and tax credits. Other income or multiple employers can change the final liability.

T03Which ITR should I use if I have a salary and freelance income?

First determine whether the additional receipts are business or professional income. ITR-1 and ITR-2 do not accommodate income under that head. Depending on the facts and presumptive-scheme eligibility, ITR-3 or ITR-4 may be relevant.

T04What documents should I prepare for income-tax filing?

Prepare your PAN, relevant-year income/tax statements, bank interest, salary certificates where applicable, tax-payment details and deduction records. Add capital-gains, property, business and foreign-income records according to your circumstances. A tailored checklist is more useful than requesting every document from every taxpayer.

T05Can I file an ITR without Form 16?

Yes. Form 16 is relevant to salary and is not a universal requirement for every taxpayer. Where salary records are incomplete, use reliable supporting information and reconcile the income and tax deducted. Do not omit salary merely because a certificate is unavailable.

T06How do I file when I changed jobs during the year?

Combine the relevant income and tax credits from all employers. Check for duplicated deductions, incomplete salary information and differences in tax calculations. Keep each employer’s certificate and relevant final-settlement records.

T07What if AIS, Form 26AS and my records do not match?

Identify the reason rather than copying the wrong figure. Compare transactions, reporting periods, tax deductions and supporting records. Use the appropriate feedback or correction process where necessary and prepare the return from the correct facts.

T08Is every credit in my bank account taxable business income?

No. Transfers between your own accounts, genuine loans and other receipts can require different treatment. Classify each credit and keep evidence. A bank statement is a starting point for reconciliation, not a complete profit calculation.

T09Can I use ITR-1 if I have two house properties?

For AY 2026–27, the official ITR-1 guidance permits up to two house properties, subject to the other eligibility conditions. The correct form still depends on residency, total income and other income/assets. Check the specific assessment year rather than relying on an older checklist.

T10Does any capital gain automatically make me ineligible for ITR-1?

Not for every AY 2026–27 case. The form permits qualifying Section 112A long-term capital gains up to ₹1.25 lakh, subject to its conditions. Other capital gains and disqualifying circumstances can require a different form.

T11What is the difference between ITR-2 and ITR-3?

ITR-2 is for applicable individuals/HUFs without business or professional income. ITR-3 accommodates such income along with other relevant income categories. The choice follows the income’s legal classification, not simply whether you call yourself employed or self-employed.

T12Who can use ITR-4?

ITR-4 is available to specified eligible resident individuals, HUFs and firms other than LLPs using qualifying presumptive taxation, subject to income limits and exclusions. It is not the default return for every small business.

T13Can every consultant use the presumptive scheme for professionals?

No. Eligibility depends on the specified profession, taxpayer category, receipts and applicable conditions. Calling an activity “consultancy” does not automatically make it eligible. Establish what work is actually performed before selecting the scheme.

All 12 states
T14Do I need records if I use presumptive taxation?

You should retain reliable evidence of receipts, banking, taxes and eligibility even where the scheme simplifies specified accounting obligations. Presumptive taxation does not remove GST, TDS, company-law or other independent requirements.

All 12 states
T15Does every business need a tax audit?

No. Tax-audit applicability depends on the year, activity, turnover/receipts, cash conditions, scheme choices and other provisions. A company’s statutory audit is a separate requirement and should not be confused with a tax audit.

T16Should I choose the old or new income-tax regime?

Compare the actual liability using your income and eligible deductions for the relevant year. The default regime, election process and switching restrictions can differ for taxpayers with business income. A previous year’s decision should not be copied automatically.

T17Do freelancers and business owners need to pay advance tax?

They may need to, depending on their estimated liability and available tax credits. Applicable instalments and presumptive-scheme rules must be considered. Waiting until return filing can result in interest where advance-tax obligations existed.

All 12 states
T18Should I file a return if my business made a loss?

Often, yes. Filing obligations can still apply, and timely filing can affect the treatment or carry-forward of certain losses. Keep proper evidence of the loss and review the applicable rules rather than assuming there is nothing to report.

All 12 states
T19Why has my income-tax refund not arrived?

Check return verification, processing status, bank validation, notices and any adjustment against an outstanding demand. A refund depends on the department’s processing and the correct information. A consultant cannot promise a fixed refund date.

All 12 states
T20Is uploading my ITR enough to complete filing?

No. Complete the applicable verification requirement as well. The current general verification timeline is 30 days from filing; late verification can affect the effective filing date and consequences. Retain the acknowledgement and verification status.

T21Can I file income-tax returns for earlier years that I missed?

There may be an available route, but it depends on the year, eligibility and statutory time limits. An updated return is not available for every purpose, including every refund or loss claim. Review each year separately before promising that all missed returns can be filed.

All 12 states
T22Can I correct a return after filing it?

The appropriate route may be a revised return, rectification, updated return or response to a communication, depending on the issue and time limits. These routes are not interchangeable. Keep the original return and identify precisely what needs correction.

All 12 states
T23What should I do after receiving an income-tax notice?

Check that the communication is genuine, identify its purpose and deadline, and preserve the complete document. Gather the return, computation and issue-specific evidence. Respond through the appropriate authorised process rather than ignoring it or sending an unrelated generic reply.

T24Can an NRI obtain help with Indian income-tax filing remotely?

Yes, much of the preparation can be coordinated remotely. The correct treatment depends on tax residency and the nature/source of income, not citizenship alone. Indian rent, property sales, interest and other receipts can require different analysis.

All 12 states
T25Do I need to report foreign income or overseas assets?

That depends on your residency category, income and the relevant reporting rules. A foreign account, overseas shares or employee stock benefits can require additional review. Do not assume that receiving no money in an Indian bank removes reporting obligations.

T26Are FY 2025–26, AY 2026–27 and Tax Year 2026–27 the same?

No. FY 2025–26 income is associated with AY 2026–27 under the earlier framework. Tax Year 2026–27 relates to the new framework beginning on 1 April 2026. Forms, terminology and legal references must match the period being handled.

T27Does moving to Sikkim make all my income tax-free?

No. Special exemptions depend on the legally defined eligible individual, relevant income and applicable provisions. Merely moving an address, opening an office or incorporating a company in Sikkim does not establish blanket exemption.

T28Is everyone living in Northeast India exempt from income tax?

No. Specific exemptions can apply to eligible persons and qualifying income under detailed conditions. State residence alone is insufficient, and an individual’s eligibility does not automatically extend to a company or LLP. Assess the person, area, income source and relevant tax period. **8.
